DealWell, LLC (“DealWell,” “us,” “we,” or “our”) respects your personal privacy and is committed to adhering to the applicable privacy and data protection laws and industry guidelines.  This privacy policy ("Privacy Policy") describes how we handle the personal information that you to provide to us on this website ("Site") and/or through your use of the DealWell Service.  This policy applies only to the Site and not to any third-party sites that may be accessible from here. Capitalized terms not otherwise defined in this Privacy Policy have the meanings given to them in the DealWell Terms of Use AgreementAfter reading this Privacy Policy, which is incorporated into and is a part of the DealWell Terms of Use Agreement, you will know:

1. INFORMATION WE COLLECT FROM YOU
Your Consent
By using the Site and the DealWell Service or providing personal information to us, you are consenting to the collection, use and disclosure of your personal information described in this Privacy Policy.
If you do not consent to the collection, use and disclosure of your personal information as described in this Privacy Policy, do not use the Site or the DealWell Service, or contact us pursuant to Section 2 below.

Active Information Collection
If you purchase a Certificate from us, we request certain personally identifiable information from you.  You must provide contact information (such as name and e-mail) and financial information (such as credit card number, expiration date).  We use this information for billing purposes and to fill your orders.  If we have trouble processing a purchase, we will use this information to contact you.
Further, like many other web sites, we also actively collect information from our visitors both by asking specific questions on this Site and by permitting you to communicate directly with us via e-mail.  Some of the information that you submit is personal information.  Examples of such personal information are your first and last name, home and any other physical addresses and zip codes, e-mail address, phone number, Account ID and password, gender, and date of birth.  DealWell uses this information for the purposes for which you provide it. 

Passive Information Collection
Some of the information we collect depends on the settings on your web browser.  Please check your web browser if you want to learn what information your browser sends or how to change your settings.  In addition to the information sent by your web browser, as you navigate through a web site, certain information can be passively collected (that is, gathered without you actively providing the information) using various technologies and means, such as navigational data collection.
Due to the communications standards on the internet, when you visit the Site, DealWell automatically receives the URL of the site from which you came and the site to which you are going when you leave the Site. We also receive the internet protocol (“IP”) address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, email patterns, your mobile device (including your UDID) and mobile operating system (if you are accessing the Site using a mobile device), as well as the name of your ISP or your mobile carrier. In addition, DealWell receives information about the areas you visit on the Site.  DealWell may also receive location data passed to it from third-party services or GPS-enabled devices that you have enabled. You can control the collection and use of this information. The link between your IP address and your personally identifiable information is not shared with third parties, except as may be required as described in Section 3 below.
Like most websites, we use cookies and web log files to track site usage and trends, to improve the quality of our service, and to customize your experience on the Site.  A cookie is a tiny data file that resides on your computer, mobile phone, or other device, and allows us to recognize you as a user when you return to the Site using the same computer and web browser. You can remove or block cookies using the settings in your browser, but in some cases doing so may impact your ability to use the Site and DealWell Service.  One type of cookie, known as a “persistent” cookie, is set once you’ve logged in to your account.  The next time you visit the Site, the persistent cookie will allow us to recognize you as an existing user so you will not need to log in to your account.  Another type of cookie, called a “session” cookie, is used to identify a particular visit to the Site.  Session cookies expire after a short time or when you close your web browser. We may use cookie-equivalent technology for the limited purpose of enhancing the security of DealWell’s services. We also may use browser storage or cache technology to track site usage and trends, to improve the quality of our service, and to customize your experience on the Site.  
We passively collect information to understand what areas of this site are most popular, which areas may require improvement and what technologies are being used by Users.  This information helps us to update and improve the Site and the DealWell Service.  We also use this information for security purposes, to detect and to block security breaches and to provide you with a safe online environment. This information is anonymous and non-personally identifiable information.  We may use this anonymous non-personally identifiable information to statistically monitor how many people are using the Site and the DealWell Service and may share this information with others for purposes of procuring advertisers or sponsors.

Limitations on the Collection, Use and Disclosure of Personal Information
To the extent required by applicable law, whenever DealWell collects personal information on the Site, we will:

  • provide timely and appropriate notice to you about its data practices;
  • collect, use, disclose and transfer your personal information only with your consent, which may be express or implied, depending on the sensitivity of the personal information, legal requirements, and other factors;
  • collect your personal information only for specific, limited purposes. The information we collect will be relevant, adequate and not excessive for the purposes for which it is collected;
  • process your personal information in a manner consistent with the purposes for which it was originally collected or to which you have subsequently consented;
  • take commercially reasonable steps to ensure that your personal information is reliable for its intended use, accurate, complete, and, where necessary, kept up-to-date;
  • not use your personal information for direct marketing purposes without your having elected to "opt-in" to receive such communications; and
  • take appropriate measures, by contract or otherwise, to provide adequate protection for personal information that is disclosed to a third party or transferred to another country, including transfers within DealWell.

Retention of Personal Information
DealWell retains the personal information collected on the Site as long as necessary to provide the services, products and information you request or as permitted by applicable law.
DealWell usually uses the personal data you have provided to respond to your inquiry or provide you access to specific information or offers. Also, to support our customer relationship with you:

  • we may store and process personal data and share it with our affiliates to better understand your business needs and how we can improve our products and services; or
  • we (or a third party on our behalf) may use personal data to contact you about an offer in support of your needs, to provide you with reminders concerning the status of your purchases, to conduct online surveys to understand better our customers' needs, or to otherwise support our customer relationship with you.

We will retain your IP Address for purposes of detecting any fraudulent uses of the Site. 
We may also disclose information about you that is not personally identifiable. For example, we may provide our Providers, business partners, or other third parties with data and reports that contain aggregated and statistical data about DealWell’s Users.
We may share a User’s personal information with Providers in order to verify a valid purchase of a Certificate and/or the identity of the Certificate holder or for other customer service purposes.  We will not share with any Provider any credit card or other financial information you have provided in connection with your purchase of a Certificate. 
We may also disclose your personal information and other information you provide to another third party as part of a sale of the assets of DealWell, a subsidiary or division, or as the result of a change in control of the company.  Any third party to which DealWell transfers or sells its will have the right to continue to use the personal and other information that you provide to us.

2. CHOICES YOU HAVE ABOUT HOW DEALWELL USES YOUR INFORMATION
We strive to provide you with as many choices and as much control as possible regarding the personal information you provide to us.  We have created mechanisms to provide you with the following control over your information:
You may also send us an e-mail message at support@dealwell.com to request access to, correct or delete any personal information that you have provided to us, to the extent it is technically and reasonably feasible for us to do so.  To protect your privacy, we will only respond to e-mail messages sent from the e-mail account you used to set up your account. Should you elect to have your information deleted, we will also delete your user account.
If you do not wish us to collect cookies, you may set your browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of the Site or the DealWell Service may then be inaccessible or not function properly.
If you do not want any information collected, then you should choose not to use the Site or the DealWell Service.

3. HOW WE PROTECT YOUR INFORMATION AND WHEN IT MAY BE REQUIRED TO DISCLOSE YOUR INFORMATION
Protection of Your Information 
We work hard to protect your personal information.  DealWell will never sell personally identifiable information collected from the Site to mailing list brokers.  All such personally identifiable information is stored within a secured database that is not accessible to the outside world except to our service providers.  All DealWell servers are protected behind both hardware and software firewalls. Low-level access to all information is restricted to authorized support personnel only.
This Site contains links to other web sites operated by third parties that may be of interest to you.  We cannot control these third-party sites, which may collect personal information from you.  When you follow a link and leave this site, you do so at your own risk.

When DEALWELL May Be Required to Disclose Your Information
It is possible that we may need to disclose personal information you have submitted and/or information about your use of the Site or the DealWell Service when required by subpoena or other legal process, or if DealWell has a good faith belief that disclosure is necessary to (a) investigate, prevent or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (b) to enforce the Terms of Use Agreement, to investigate and defend ourselves against any third party claims or allegations, or to protect the security or integrity of our Site; and/or (c) to exercise or protect the rights, property or personal safety of DealWell, our Site users, employees, or others.

4. WHAT WE DO ABOUT CHILDREN VISITING THIS SITE
This site is not intended for children under the age of 13.  We will not knowingly collect information from site visitors in this age group in accordance with the Children’s Online Privacy Protection Act (“COPPA”).  If you are a parent or legal guardian, you may, in compliance with the Terms of Use Agreement, use the Website on behalf of your minor child.  Any such information provided will be treated as personal information as otherwise provided herein. In fact, in accordance with COPPA, children under the age of 13 are prohibited from use the Site. If we obtain actual knowledge that we have received any information from an individual under the age of 13, we will take commercially reasonable steps to delete that information from our own servers. In addition, we encourage parents to talk to their children about their use of the Internet and the information they disclose online.

5.  HIPAA AND YOUR PERSONAL HEALTH CARE INFORMATION
DealWell will not collect, and will therefore have no responsibility for collecting, any medical history, individually identifiable health information, or any other personal health information of yours in connection with the DealWell Service (“User Health Information”).  Medical, health and wellness providers, their employees, and their agents (“Providers”) will be solely responsible for the collection and safeguarding of all such User Health information.  
DealWell is not a covered entity as the term is defined by the rules and standards promulgated pursuant to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), nor is DealWell performing a function on behalf any Provider which would cause DealWell to be considered a business associate for purposes of HIPAA.  As such, DealWell the requirements and protections applicable to the use and disclosure of User Health Information which constitutes protected health information under HIPAA do not apply to the information received by DealWell.  Users must look solely to Providers with respect to obligations of patient confidentiality under HIPAA or otherwise.  DealWell does not have, and will not accept, any obligations of confidentiality with respect to any communications other than those expressly stated in this Privacy Policy and the DealWell Terms of Use Agreement.
